Intellectual Property

The Services — including all content, design, code, graphics, logos, and trademarks — are owned by MoonsWhale LLC or its licensors and are protected by intellectual property laws. The MoonWhale name and logo may not be used without our prior written consent. You may view and share our public content for personal, non-commercial purposes with attribution; any other use requires permission.

Client work displayed on this site remains the property of the respective clients and is shown for portfolio purposes.

Open-Beta Tools

Tools published through MoonWhale AI Lab are experimental and provided free of charge, "as is" and "as available", for evaluation purposes. They may change, break, or be withdrawn at any time without notice. Outputs are generated by AI systems and may be inaccurate, incomplete, or unsuitable for your purpose — you are responsible for reviewing outputs before relying on them.

You retain any rights you hold in content you submit to the tools. You grant us a limited license to process that content to operate and improve the tools, as described in our Privacy Policy.

Client Engagements

Professional services (strategy, design, development, AI products) are governed by separate written agreements or proposals. In case of conflict between these Terms and a signed agreement, the signed agreement prevails for that engagement.

Third-Party Links & Services

The Services may link to third-party websites, products, or model providers. We are not responsible for their content, policies, or practices, and a link does not imply endorsement.

Disclaimers

The Services are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, MoonsWhale LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed one hundred US dollars (US $100) or the amount you paid us for the Service giving rise to the claim, whichever is greater.

Indemnification

You agree to indemnify and hold harmless MoonsWhale LLC and its officers, employees, and partners from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms.

Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date above reflects the latest version; continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
